    Default Separation

    I live in Bakersfield with my husband and our children. We are not usa citiezen
    and neither residents. I read that we can not divorce, but we can be separate.
    My husband is working with a H1B viza and I am not able to work. I have an H4
    viza. Have I some wrights in your country? Could I separate from him and take my children with me? I will need financial support from him for me and for my children. They are : 20 years old(is student) and 9 years old. We are married from 1989.
    My husband has a mortgage for the house.

    Divorce is actually referred to as a dissolution /or legal separation under Arizona law!

    We use "dissolution" and "legal separation" here in California as well, although the two terms are not interchangable and there are important distinctions between the two.

    Driada, you can separate from your husband, but you may need to go through mediation to determine a parenting plan for your children. Depending on what the parenting plan is and what your incomes are, you can also request child support.
