    Default Statute of LImitations

    Anyone know what the statute of limitations is on Child Support payments lost somewhere between Sacramento county, where they were collected and Placer county, where they were supposed to be distributed?

    Hi Martha,
    I'm not sure exactly what you mean by "statute of limitations" in a situation like this. Normally, there isn't a "statute of limitations" on collecting unpaid child support and there is also a specific family code section that says that "laches" can't be used as a defense in child support arrears cases. "Laches" is similiar to statutes of limitations and is basically a claim that someone waited to long to bring their claim.

    The courts are very lenient about claims for child support arrears. If I'm understanding your question though, the County is the one that hasn't paid child support it's collected? I think I need to know a little more about the situation. Isaac
