    Default Still receive statements

    I filed for Chapter 7 bankruptcy in June 2009, discharged in July 2008. Our house was surrendered to the creditors at that time. Neither the 1st or 2nd mortgage lender has taken possession of the property leaving it vacant for almost one year. We still receive statements from the first mortgage lender at our new address showing an ever climbing balance due with penalties and interest being added each month.

    I am told that after three years after the transfer of the property we are eligible to purchase a new home, however since the lenders have not taken possession of the property we have lost one year, what action should we take to resolve this issue?

    Thats good you have a record of payments made

    They might say they only have to give you a statement of account every so often. If so you want to know how regularly they will provide them.

    I think you have to talk with your attorney.they will help you in the right way in this issue.
