Default Beneficiary deed

Does California have beneficiary deeds and if so, what problems exist for their use?

Hi Jean,

Thank you for your question. I haven't heard that term before. What are beneficiary deeds? Isaac

Unhappy California does not have Beneficiary Deeds

No, California does not have beneficiary deeds, also known as transfer on death (TOD) deeds. Many states do, but California is a laggard.

For a couple of years in a row, the California Law Revision Commission has introduced legislation that would authorize them in California but, sadly, the Trusts & Estates Section of the State Bar of California, in a transparently self-servicing move, has consistently opposed the legislation, preferring that the elderly hire expensive trusts & estates attorneys to do their estate planning.
